You Agree to

By using our Site, you are agreeing to these Terms. Please read them carefully as they constitute the terms and conditions of a legally binding agreement between you and the company. Your Matjer4u Account

Users may be given the opportunity to register via an online registration form to create a User account, (“My Account”) that may allow you to receive information from us and/or to participate in certain features or access of the Site. We will use the information you provide in accordance with our Privacy Policy. With respect to any such registration of your Account, we may refuse to grant to you the username you request.

You are responsible for:

  • Providing the current, complete and accurate information, at the time of registration of your account, update your information on web site.
  • Creating the password at the time of registration. You also acknowledge and agree that we may rely on this password to identify you
  • All use of your Account, regardless of whether you authorized such access or use, and for ensuring that all use of your Account complies fully with the provisions of these Terms of Service.
  • Using this account for personal or individual use only.
  • All activities that occur under your Account.

To protect our Site from being misused, we have made some rules that apply to every user equally. These rules have been erected solely to ensure that every Matjer4u user enjoys the experience on our Site without interruption. We reserve the right to terminate your use of the Site and/or the Account for violating any of the prohibited uses or for any other reason in our sole and exclusive decision.

  • Access the Site other than through the interface that is provided by Matjer4u, unless you have specifically been permitted to do so in a separate written agreement signed by an authorized representative of Matjer4u.
  • Use Site for purposes that are not permitted by this Terms & Condition and against any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

Typographical Errors

We strive for accuracy in all item’s descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our Site. Due to human error and other determinates we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our Web site is labeled with an incorrect price due to some typographical, informational, technical or other error, we shall at our own sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Additionally, all hyperlinks to other websites from our Site are provided as resources to customers looking for additional information and/or professional opinion. Matjer4u do not assume responsibility for the claims and/or representations made on these or any other websites.

Security

Matjer4u will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to information you may provide. Majeure force

We will not be liable for any delay or failure to perform any of our obligations under the Site Terms here in the event of causes, events or other matters beyond our reasonable will.

Governing Law

This User Agreement is governed by, and construed in accordance with, Abu Dhabi-UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason.

Disputes

If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute.

In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day-period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration as set out below, under the Arbitration Rules of the Dubai International Financial Centre. The arbitration proceedings shall be conducted in the Arabic language and the award shall be in Arabic.

Feedback

We reserve the right to modify or delete your feedback, if it contains the content against Matjer4u or its affiliated business partners. You also agree not to use any pseudo name or fake identity to post feedback. We will delete feedback from pseudo accounts and might take legal action against the feedback poster.

LIMITATIONS OF LIABILITY

IN ALL CIRCUMSTANCES MATJER4U’S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. MATJER4U SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. MATJER4U SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT MATJER4U HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it (Sorry for that). Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to Matjer4u and we shall treat any such unauthorized use as subject to the Terms.

Matjer4u reserve the right to cancel any unpaid order under any circumstances without any owed liability towards customer or otherwise, in-case of paid order we still reserve this right as long as paid amount is returned in full.

Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned or licensed property of Matjer4u or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all content on the Site is the exclusive property of Matjer4u. We and our suppliers and licensors expressly reserve all intellectual property rights in all Content.

Updates

We may from time to time modify or change the Terms. The revised Terms will govern your future use of our Site, so we strongly suggest that you visit and review our Terms periodically. Each version is specifically dated. If you do not agree to the revised version, you must immediately stop using our Site.
